Statement by Michigan Protection & Advocacy Service, Inc. (MPAS) on the Proposed Closure of Public Juvenile Justice Facilities:

Michigan Protection and Advocacy Service, Inc. (MPAS) is Michigan’s designated protection and advocacy program, mandated to serve persons with disabilities in the Great Lakes State.

Closing public juvenile justice facilities and contracting those services to private entities may impact the lives of children and youth with disabilities who are placed in those facilities.  Any proposal to contract juvenile justice services to private providers must include the following safeguards:

* Contracts must assure provision of special education and mental health services.

* Contracts must allow MPAS access and provide a private right of action.

* Contracts must assure that state policies, program philosophy, and the Maxey DOJ agreement are followed in all facilities.

* Contracts must limit and provide due process for out of state placement.       

* Contracts should limit new facility construction unless part of an overall state plan to reform the provision of juvenile justice services.  Such a plan should be based on less restrictive home- and community-based service models.

The preceding statement was released by MPAS in regards to the proposed closure of the W.J. Maxey Boys Training School in Whitmore Lake, MI.
